This Privacy Policy applies to everyone who interacts with our Services, including customers, users of our apps, anyone who signs up to receive promotional materials from us or enters any of our promotional campaigns, or anyone who interacts with us on social media.

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

• Personal contact details including your name, address, billing address, shipping address, phone number, and email address.
• Characteristics or demographics, such as your age, date of birth, and country.
• Payment information including credit card, debit card, and financial account numbers, payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details. This information is processed by our payment processors.
• Account information including your username, password, security questions, preferences and settings.
• Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
• Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.
• Device information including information about your device, browser, or network connection, your IP address, location data, and other unique identifiers.
• Internet activity data, including information regarding your interaction with the Services, browsing history and interactions, pages and screens you viewed, items placed in shopping carts and items abandoned.
• Contact identifiers for other individuals, such as first and last names, email addresses, and postal addresses about others for whom you purchase a gift.

We may collect personal information from the following sources:

• Directly from you including when you use the Services. When you create an account, visit or use the Services, make a purchase, communicate with us, sign-up for our marketing materials, participate in a promotion, respond to our surveys, contact support, or otherwise provide us with your personal information. Please do not provide any personal information that we do not request.
• Automatically through the Services including from your browser or device when you use our products or services or visit our websites, and through the use of cookies and similar technologies.
• Social media platforms with which you interact. When you interact with our content on social media, we may collect personal information such as your contact identifiers and any comments you provide. We may also receive additional information from the social media platform that you have authorized the platform to disclose to us. If you publicly reference our Service on social media (such as by using a hashtag associated with us in a tweet or post), we may use your reference on or in connection with our Service.
• From other sources, including: Business partners, such as those engaged in joint marketing or promotional activities. Data providers, such as data licensors and public databases. Public sources, such as blogs, forums, or where data is in the public domain. Third party vendors and advertising partners.
• Personal information we infer from other information we collect, including by generating new information about your likely preferences.

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

• Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges, or other transactions, to create, maintain, and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.
• Direct Marketing. We use your personal information to send you Solly Baby-related marketing communications through email, text messaging, newsletters, or direct mail, as permitted by law. You will always have the ability to opt out of our marketing communications as described in Your Rights and Choices below.
• Security and Fraud Prevention. We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our Services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.
• Communicating with You. We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you.
• Legal Reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.
• For research and development. We may use your personal information for research and development purposes, including to analyze and improve our products and our business, for example through use of surveys or cookies and other technologies. You may have the ability to limit some analytics through cookies and other technologies as described in Your Rights and Choices below.
• Promotions/Sweepstakes/Contests. When you voluntarily enter a promotion, sweepstakes, or contest that we sponsor, we use information as set out in the official rules that govern the promotion as well as for administrative purposes and as required by law. 
• Shared Content.  From time to time, we may offer referral services that allow you to forward or share content, such as an email inviting your friend to use our Services or purchase our products.
• Advertising. We work with agencies, ad networks, technology providers, and other third-party advertising companies to display ads on our Service and other websites and services. As part of this process, we incorporate cookies and similar technologies to automatically collect personal information about you over time across our Service and other non-affiliated sites and services or your interaction with our emails, and use that personal information to serve ads that we think may interest you. This process is known as “targeted advertising.” You can learn more about your choices regarding targeted advertising in the Your Rights and Choices section below and our Cookie Policy. We also use audience matching services (which is a type of targeted advertising) to reach people who have visited our Service or are identified in one or more of our databases (“Matched Ads”). This is done by us providing a list of hashed email addresses to a third party or incorporating a pixel from a third party into our own Service, and the third party matching common factors between our data and their data. For instance, we incorporate the Facebook pixel in our Service and may disclose your hashed email address to Facebook as part of our use of Facebook Custom Audiences.

Sometimes we aggregate or de-identify information where it will no longer be considered personal information. We may use such information for any purpose to the extent permitted by law.

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

• Service providers. Shopify, vendors, and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).
• Business and marketing partners. To provide marketing services and advertise to you, or to offer co-branded products or engage in joint promotional activities. We may also allow third party advertising partners to set tracking tools (e.g., cookies) to collect information regarding your activities on our Services. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites. • Other third party vendors. When you direct, request, or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
• Affiliates. With our affiliates or otherwise within our corporate group.
• Professional advisors or business transferees. Such as lawyers, bankers, auditors, or insurers or in connection with a business transaction such as a merger, financing, sale, or bankruptcy. 
• Authorities or others for security or legal enforcement.  To comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.
• The public and social sharing features. The Services may offer third party social sharing features and other integrated tools, which let you share actions you take on our Services with other media. The use of such features may enable the sharing of your information with your friends or the public, depending on the settings you establish with the third party that provides these features. The third-party provider may also collect other information in connection with your use of their feature or may set a cookie to enable the features to function properly. We never sell or share children’s or baby-related information for advertising purposes.

We want to communicate with you, but only if you want to hear from us. Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

Data Subject Requests. 

• Right to Access / Know. You may have a right to request access to personal information that we hold about you.
• Right to Delete. You may have a right to request that we delete personal information we maintain about you.
• Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
• Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.

Right to Opt Out of Sale or Sharing for Targeted Advertising.

Depending on where you reside, you may have a right to opt out of the "sale" or "share" of your personal information or to opt out of the processing of your personal information for purposes considered to be "targeted advertising", as defined in applicable privacy laws. 

To opt-out of sales or shares or the processing of personal information for targeted advertising purposes, please submit a request to info@sollybaby.com.

 You may also turn on a recognized opt-out preference signal, such as Global Privacy Control, in your browser or extension. Please note that when you opt-out through such method we do not know who you are within our systems, and your opt-out will apply only to personal information collected from tracking technologies on the specific browser from which you opt-out. If you delete or reset your cookies, or use a different browser or device, you will need to reconfigure your settings.

Managing Communication Preferences. 

• Email.  We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made. 
• Text.  If you opt in, we may send you messages via SMS or similar messaging services. These messages will include updates, promotions, or service-related communications. You may opt out of Solly Baby SMS messages at any time. To unsubscribe, text the single keyword command STOP to +1 (833) 654-4262. You will receive a one-time confirmation and will no longer receive messages unless initiated by you.
• Push Notifications. You may opt out of push notifications by adjusting your device setting or uninstalling our apps.
• Direct Mail.   If you would like to opt-out of receiving communication via postal mail, contact info@sollybaby.com. To learn more about your rights as a consumer and to receive less national advertising mail, please visit the Direct Marketing Association at http://www.dmachoice.org.

Accounts. 

If you have registered an account with us, you may review and update certain personal information in your account profile or delete your account in its entirety through your account settings. 

Do Not Track (DNT) Signals. 

Your browser may allow you to set a Do Not Track (DNT) signal indicating you do not wish your online activity to be tracked. Currently, our system does not support and cannot act on DNT signal headers that we may receive.

Cookies and Similar Technologies.

You may stop or restrict the placement of cookies on your computer or remove them from your browser by adjusting your web browser preferences. Please note that cookie-based opt-outs may not be effective on mobile interfaces. However, on many mobile devices, application users may opt-out of certain mobile advertisements via their device settings. The online advertising industry also provides websites from which you may opt-out of receiving targeted ads from our data partners and our other advertising partners that participate in self-regulatory programs. You can also choose not to be included in Google Analytics https://tools.google.com/dlpage/gaoptout. Please note that cookie-based opt-outs must be performed on each device and browser that you wish to have opted-out. You must separately opt-out on each device. Advertisements on third party websites that contain the AdChoices link, and that link to this Privacy Policy, may have been directed to you based on anonymous nonpersonal information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt-out of the advertising partners’ use of this information for interest-based advertising purposes.

Matched Ads. 

To opt out of us disclosing your hashed email address to third parties for Matched Ads purposes, please submit a request to info@sollybaby.com. To the extent permitted by law, we will remove your email address from any subsequent lists disclosed to third parties for Matched Ads purposes. 

• If you reside in the UK or European Economic Area, and subject to exceptions and limitations provided by local law, you may exercise the following rights in addition to the rights outlined above:
• Objection to Processing and Restriction of Processing: You may have the right to ask us to stop or restrict our processing of personal information for certain purposes.
• Withdrawal of Consent: Where we rely on consent to process your personal information, you have the right to withdraw this consent. If you withdraw your consent, this will not affect the lawfulness of any processing based on your consent before its withdrawal.

We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

When you shop with us or create an account, you may choose to share limited information about your child (for example, age, birth month, or gender) so we can recommend age-appropriate products or offers. We collect this information only from parents or guardians, not directly from children, and treat it as personal information because it relates to you or your household.

We use this information only for:

• Personalizing your shopping experience (such as showing products or promotions relevant to your child’s age);
• Improving our product recommendations and inventory planning; and
• Sending optional milestone-based communications, if you’ve opted in.

The Services are intended for adults and not intended to be used by children under 13 years of age. We do not knowingly collect any personal information directly from children under 13 or the age of majority in your jurisdiction. If you are the parent or guardian of a child and believe we have been provided with their personal information, you may contact us using the contact details set out below to request that it be deleted. 

We utilize organizational, technical, and physical safeguards that are designed to protect personal information we collect. However, please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

We retain information for the length of time that is reasonably necessary for the purpose for which it was collected, and as necessary to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements.

Solly Baby is headquartered in the United States and we may service providers in other countries. Please note that we may transfer, store and process your personal information outside the country you live in. Where required by applicable law, we will provide appropriate safeguards for data transfers, such as through the use of standard contractual clauses.

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority. For the EEA, you can find a list of the responsible data protection supervisory authorities here.

If we deny a privacy request, you may appeal the decision to us at info@sollybaby.com. To the extent possible, please describe the basis for your appeal and if there is any specific personal information that concerns you. We will endeavor to provide a prompt response. If we deny your appeal, you can raise concerns with your state’s Office of the Attorney General.

When you make purchases through the Services, we process your payments through a third-party payment processor, which may collect certain financial information from you to process a payment on our behalf. In such a case, the use and storage of your financial information is governed by the third party’s terms, conditions, and privacy policies. You may elect to receive text messages from us. When you sign up to receive text messages, we may send you information about promotional offers and more. These messages use information automatically collected based on your actions while using our Services and may prompt messaging such as cart abandon messages. To the extent you voluntarily opt to have SMS notifications sent directly to your mobile phone, we may receive and store the information you provide, including your phone number. You may opt out of receiving text messages at any time by texting “STOP” to our text messages.

We offer our customers a loyalty program (the Cloud Nine Rewards Program) that provides certain perks, such as rewards and exclusive offers. We may also provide other programs, such as sweepstakes, contests, refer a friend, or other similar promotional campaigns (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our Programs involve the collection of personal information and offering of certain benefits, they might be interpreted as a “financial incentive” program under California law or a “bona fide loyalty program” under Colorado law. Under California law, the value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants.

Some states have laws that give their residents specific rights around their personal information. We want to make sure you understand your privacy choices.

Notice to California Residents

We are required by the California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (“CPRA”) to provide to California residents an explanation of how we collect, use and disclose their personal information, and of the rights we offer to California residents with respect to that personal information. • What is a “sale” under California law is not yet clear, but  we do not sell personal information as that term is traditionally understood. However, some of our disclosures of personal information may be considered a “sale” or “share” as those terms are defined under the CPRA. A “sale” is broadly defined under the CPRA to include a disclosure for something of value, and a “share” is broadly defined under the CPRA to include a disclosure for cross-context behavioral advertising. We may collect, sell, or share the following categories of personal information for commercial purposes: contact identifiers, characteristics or demographics, commercial or transactions data, profile data, device identifiers, device data, internet activity data, non-precise location data, and inferences drawn from any of the above. Some of the personal information we collect may be considered sensitive personal information under CPRA. For example, account credentials. We may collect, use, and disclose such sensitive personal information only for the permissible business purposes for sensitive personal information under the CPRA or without the purpose of inferring characteristics about consumers. We do not sell or share sensitive personal information.

Right to Access, Correct, or Delete Your Information

You have the right to request access to, and a copy of, the following for the 12 months preceding your request:

• categories of personal information we have collected about you;
• categories of sources from which the personal information was collected;
• categories of personal information about you we disclosed for a business purpose or sold;
• categories of third parties to whom the personal information was sold or disclosed for a business purpose;
• business or commercial purpose for collecting or selling the personal information; and
• specific pieces of personal information we have collected about you.

You also have a right to request that we delete your personal information (subject to certain exceptions), and request that we correct your personal information if it is inaccurate. We will use commercially reasonable efforts to honor your requests, in compliance with applicable laws. Please note, however, that we may need to retain certain information such as for our legitimate business purposes or as required to comply with applicable law. In the request, please specify which right you are seeking to exercise and the scope of the request. We may require specific information from you to verify your identity before processing your request, and we may send you a confirmation email that you must respond to before we process the request. Due to our privacy-protective practices, in some instances we may not have sufficient personal information (e.g., name, email) that would enable us to verify an individual’s identity and complete a request to know or delete information.

California residents can submit access and deletion requests by emailing us at info@sollybaby.com. California residents can also request that we delete your information through your account settings. You have the right not to receive discriminatory treatment for the exercise of your California privacy rights, subject to certain limitations.

Right to Opt-Out of Sales and Sharing

To the extent we “sell” or “share” your information as those terms are defined under the CPRA, you have the right at any time to opt out of (i) selling or sharing of your personal information to third parties, and (ii) third party targeted advertising activities by contacting us by calling us toll free at 760-707-3243 or by sending an email to info@sollybaby.com.

Authorized Agent. 

An authorized agent may submit an access or deletion request on your behalf by sending a written authorization signed by you to info@sollybaby.com. We may still require you to directly verify your identity and confirm that you provided the authorized agent permission to submit the request.

Shine the Light. 

California’s “Shine the Light” law (California Civil Code § 1798.83) allows California residents to ask companies with whom they have formed a business relationship primarily for personal, family, or household purposes to provide certain information about the companies’ sharing of certain personal information with third parties for their direct marketing purposes during the preceding year (if any). You can submit such a request by contacting us by emailing info@sollybaby.com with “Shine the Light” in the subject line. The request must include your current name, street address, city, state, and zip code and attest to the fact that you are a California resident. We may require additional information from you to allow us to verify your identity and are only required to respond to requests once during any calendar year.

Notice to Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Utah, and Virginia Residents

For residents of Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia, our practices regarding the collection, use, disclosure, and retention of your personal data are set out in the main Privacy Policy above.

In addition to the rights set forth above, you may have the following additional rights under applicable law of your region:

• To confirm whether or not we are processing your personal data, and in some regions, confirm the categories of personal data we have processed
• To access your personal data
• To correct inaccuracies in your personal data
• To delete your personal data
• To obtain a copy of your personal data that you previously provided to us in a portable and readily usable format

If you are an Oregon resident, you also have the right to receive a list of the specific third parties to which we have disclosed personal data.

If you are a Delaware resident, you also have the right to obtain a list of categories of third parties to which we have disclosed your personal data.

To exercise any of these rights, please follow the instructions for data subject requests in the Your Rights and Choices section above. Please note these rights are subject to exceptions. We will do our best to respond to your request within 45 days. If you have an account with us, we may require you to use the account to submit the request. We may require specific information from you to help us confirm your identity and process your request. We do not process personal data for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers.

You also have the right to opt out of the processing of personal data for purposes of targeted advertising or the sale of personal data. To exercise this right, please follow the instructions for opting out of sales, shares, and targeted advertising in the Your Rights and Choices section above.

You can also request that we delete your information through your account settings. You have the right not to receive discriminatory treatment for the exercise of your privacy rights, subject to certain limitations.

An authorized agent may submit an access or deletion request on your behalf by sending a written authorization signed by you to info@sollybaby.com. We may still require you to directly verify your identity and confirm that you provided the authorized agent permission to submit the request. Requests must be submitted through the designated methods listed above. 

You have the right to revoke consent previously given to us for the processing of your personal data. To revoke consent, write us at the email or postal address set out in the Contact section above (specifying the right you wish to exercise).

If we refuse to take action on a request, you may appeal our decision within a reasonable period time by contacting us at info@sollybaby.com and specifying you wish to appeal. Within 60 days of our receipt of your appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions.
